These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and VIC School Reports ("Company", "we", "us", or "our") regarding your use of our platform and services.

By accessing or using VIC School Reports, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our services.

VIC School Reports provides an AI-powered platform designed to assist Victorian teachers in generating report comments that align with Victorian Department of Education standards and Victorian Curriculum requirements.

Our services include:

Eligibility and Account Requirements

Eligibility

Our services are intended for use by qualified educators, including:

• Victorian registered teachers
• Education support staff with appropriate authorisation
• School administrators and leadership teams
• Education organisations working with Victorian schools

Account Responsibilities

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account with others or allow others to access your account

Acceptable Use

Permitted Use

You may use our services to:

• Generate report comments for students in your care
• Access educational resources and templates
• Store and manage comments for your classes
• Export comments for inclusion in official school reports

Prohibited Conduct

You agree NOT to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• Input false, misleading, or inappropriate information about students
• Attempt to reverse engineer, decompile, or disassemble any part of our AI technology
• Circumvent any security features or access controls
• Use automated systems (bots, scrapers) without our written permission
• Share, sell, or distribute content generated by our platform as your own product or service
• Upload malicious code, viruses, or any other harmful content that could damage our systems or other users
• Harass, abuse, or harm other users or our staff
• Use the platform to generate comments for students you are not authorised to report on under your professional capacity

Professional Responsibility

Intellectual Property

Our Intellectual Property

All content, features, functionality, and technology underlying VIC School Reports (including but not limited to software, AI models, text, graphics, logos, and trademarks) are owned by us or our licensors and are protected by Australian and international intellectual property laws.

Your Content

You retain ownership of the comments you generate using our platform. By using our services, you grant us a limited licence to:

• Process your inputs to generate comments
• Store your generated comments for the duration you choose
• Use aggregated, anonymised data to improve our AI models and services (in accordance with our Privacy Policy)

Fees and Payment

Subscription Plans

Access to certain features requires a paid subscription. Current pricing and plan details are available on our pricing page.

Payment Terms

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• All fees are in Australian Dollars (AUD) and include GST where applicable
• Payment is processed securely through our third-party payment processor (Stripe)
• You authorise us to charge your chosen payment method for all applicable fees

Cancellation and Refunds

• You may cancel your subscription at any time from your account dashboard
• Cancellation takes effect at the end of your current billing period
• We do not provide refunds for partial subscription periods, except as required by Australian Consumer Law
• Free trial users may cancel at any time during the trial period without charge

Disclaimers and Warranties

No Warranty on AI Accuracy

While we strive to provide accurate, VCAA-compliant report comments, AI technology is not infallible. We do not warrant that:

• Generated comments will be error-free or perfectly aligned with all reporting requirements
• The platform will be available at all times without interruption
• All features will work perfectly in all circumstances
• The service will meet all your specific needs or expectations

Service Availability

We provide the platform on an "as is" and "as available" basis. We may temporarily suspend access for maintenance, updates, or unforeseen technical issues.

Limitation of Liability

To the fullest extent permitted by law, VIC School Reports and its directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
• Any errors, inaccuracies, or omissions in AI-generated content
• Professional consequences arising from your use of generated comments (such as complaints from parents, departmental reviews, etc.)
• Loss of data, profits, or business opportunities
• Service interruptions or data breaches despite our best security efforts

Our total liability to you for any claims arising from your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

Note: Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law, including for misleading or deceptive conduct, or for guarantees that cannot be excluded.

Indemnification

You agree to indemnify and hold harmless VIC School Reports, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your professional actions or decisions made based on AI-generated content without appropriate review

Privacy and Data Protection

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using our services, you consent to our data practices as described in the Privacy Policy.

Modifications to Terms and Services

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a prominent notice on the platform. Continued use after changes constitutes acceptance of the modified Terms.

Changes to Services

We may modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of services.

Termination

Termination by You

You may terminate your account at any time by contacting us or using the account closure feature in your dashboard.

Termination by Us

We may suspend or terminate your account if:

• You violate these Terms or our acceptable use policies
• Your payment method fails or you have outstanding unpaid fees
• We reasonably believe your account has been compromised
• We are required to do so by law or regulatory authority
• We cease providing services

Effect of Termination

Upon termination:

• Your access to the platform will cease immediately
• We will delete your account data in accordance with our Privacy Policy
• You remain responsible for any fees incurred prior to termination
• Provisions that by their nature should survive termination will remain in effect

Governing Law and Dispute Resolution

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the platform will be subject to the exclusive jurisdiction of the courts of Victoria.

Before commencing legal proceedings, we encourage you to contact us to attempt to resolve the dispute informally.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VIC School Reports regarding use of our services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.
